UNICAL Dean of law faculty suspended over sexual harassment

The National Industrial Court of Nigeria in Calabar, Cross River State, has validated the suspension of the former Dean of Law Faculty, University of Calabar, Prof. Cyril Ndifon, over an alleged sexual assault.

Ndifon was on August 29, 2015 accused of sexually assaulting a 20-year-old 400-level student (name withheld) in his faculty after ordering her to his office.

Following the development, authorities of UNICAL suspended the dean from office. The suspension was to last until he was completely exonerated from the allegations on sexual assault and acts of official misconduct.

Not satisfied with the suspension, the embattled professor of law had dragged the university authorities to court in suit no. NICN/CA/01/2016, claiming, amongst others, that the institution had no power to suspend him beyond the statutory three months under the University of Calabar Act, LFN, 2004.

But in a judgment delivered on September 21, 2016 and made available to Southern City News on Friday, the National Industrial Court, presided over by Justice Eunice Agbakoba, dismissed the suit.

Agbakoba said,
The suspension of Ndifon beyond three months was not in any way invalidated under Section 16(2) of the University of Calabar Act.
She also dismissed the reliefs sought by Ndifon, adding that the professor could not restrain the university from investigating his conduct while in employment.

Those who were named as parties in the suit included the vice-chancellor, University of Calabar; Governing Council, University of Calabar and the University of Calabar as 1st, 2nd and 3rd defendants/respondents respectively.

The counsel to Ndifon could not be reached for comments.

However, the counsel to University of Calabar, Mr. Fakuta Nachamada, described the judgment of the court as not only sound in law, but also the triumph of truth over evil.

I was busy with school runs in Gwagwalada when I got a frantic call reporting the attempted rape of a first-year University of Abuja(UniAbuja) student by another first-year student of Biological Sciences called Monday. By the time I got there, the Chief Security Officer was just beginning to interview both parties, starting with the boy, Monday.

He told of how he made his ‘intentions’ known to her, and she said she would ‘think about it’ but he according to him, he didn’t understand why shy couldn’t give a straight answer, so he began making moves at ‘romancing’ her and feigns ignorance of her claims that from the moment he started, she told him to stop. He claims he only noticed her seriousness ‘when he crossed the boundary.' He is upset that he had sent her 400 naira recharge card before and didn't get why she will reject him.

The young lady insists she came by at all because he said he was not well. By the time she got in, he was playing loud music, so from the moment he began trying to have sex, she was shouting, but the loud music drowned her voice. She insists he pinned her to the mattress, and she tried strangling him with his necklace till it cut. After that, she reached for the laptop as a weapon and ripping it out turned off all the music then he released her because she could now be heard. She ran out and called for help. She got help and retrieved her phone and slippers and purse. Then she began reporting to their mutual friends and people she trusts. She insisted she injured him to. On demand, he took off his shirt and everyone saw injuries she gave him and more.

I got upset that the attitude towards gathering evidence is zero. There seemed to be a majority notion that as long as there was eventually no penetration, it is not so grievous a crime. All I insisted was to document all that could be seen as evidence before any statements are taken etc.
I applaud the lady for speaking up. We need to ensure the students and security men understand sexual harassment in its entirety and be sure whatever responses are in place take into cognizance victim needs.

I was very agitated when it seemed people were upset that ‘she was trying to make a lot out of something very small.

More people need to understand what sexual violence is and legal provisions for victims and offenders.

On Friday, there was a report about one Joseph Eidonojie-Ugbeni, a 20-year-old undergraduate of a polytechnic in Edo State, was shot in the head by some SARS officers, shooting sporadically, while chasing a suspected Internet fraudster at the Ogoja Market along LASU-Igando Road, Lagos

The police have now arrested the officer who fired the shot that killed him. It was also learnt that the suspected fraudster, Badoo, who the officers were allegedly chasing on the day of the incident, had also reported at the station and detained.

Mrs. Jonathan should apologize to Nigerians for the economic hardship - APC

The Acting National Publicity Secretary of the All Progressives Congress, Timi Frank, has dismissed recent protests by some groups in the Niger Delta in support of the wife of former President Goodluck Jonathan, Patience.

He said it was disheartening that any group in the region could hold a protest in favour of Mrs. Jonathan at the Port Harcourt zonal office of the Economic and Financial Crimes Commission, over the freezing of her account containing about $31.4m.

This was contained in a statement by Frank in Abuja, on Sunday. Frank described threats by the groups as empty and baseless.

He said,
My candid advice to Mrs. Patience Jonathan is to apologise to Nigerians for the current economic hardship which Mr. Jonathan’s regime could have easily averted instead of sponsoring shameless protests against the government. Anyway, Nigerians are still waiting for the apology.
The statement warned youths to desist from such shameless act of defending politicians for a pot of soup, adding that the current APC administration was fighting corruption so as to secure future.

The entire economy and financial system of Nigeria is in the hands of SS and SE. The Governor of CBN makes financial policy, and determines who gets what. Babatunde Fowler is from Sokoto? Fashola who is in charge of the energy, housing and road network is from Maiduguri? .

The man in charge of the entire maritime sector from which Nigeria gets highest revenue, Amaechi is from Kano? We Northerners should be the one complaining, and my reason is simple. There are about 557 agencies of government and parastatals and Buhari has not reconstituted up to 30 of these parastatals.
85% of the remaining are being headed by the people of the SS, SE and to a certain extent SW because they were GEJ’s appointees and Buhari did not remove them. As I speak to you, nobody from Yobe, Jigawa, Taraba, Gombe, Zamfara, Sokoto, Kebbi, Kogi, and Benue has been appointed as head of any federal parastatal apart from the statutory ministerial appointments.
In 2003 and 2007, Buhari picked Igbos as his running mates and got 3 votes. If Buhari doesn’t like them, don’t you think he should flush those heads of parastatals and agencies who are from those zones and give those who supported him?
He got the highest votes from Yobe State. Yet, he appointed nobody from Yobe. Same with Zamfara. If we want to build a country, we should throw away primordial sentiments, hate and spite.”
